Terms and Conditions of Sale

Effective 12 October 2026 · Version 2026-10-12

1. Provider and scope

These terms apply to purchasing the premium unlock of VitalityHub (the "app") via vitalityhub.app. The provider is Cuenca Mellima Operations, sole proprietorship of Aaron Cuenca, Neunkircherstrasse 9, 8214 Gächlingen, Switzerland ("we", "us").

The Terms of Use and the Premium License also apply to your use of the app. Conflicting terms of buyers do not apply.

2. What we offer

VitalityHub is a web app for recipes, nutrition and training. The calculators under "Tools", the Starter Cookbook and the starter training plans are free to use.

The premium unlock permanently unlocks the features described in the Premium License. It is a one-time payment, not a subscription.

With “3 days free trial” you can try the premium features on one device for 3 days, with no code, no payment details and no account. With a trial code you can try the premium features for free on one device for as long as stated with the code (for example 3 or 5 days). The trial then ends on its own, with no cancellation and no payment. There is one trial per device, and each code can be redeemed once. Codes are valid until the stated date and cannot be exchanged for money. An access code can also contain a permanent unlock (a gift, for example); the same rules apply as for the lifetime unlock. Anything you create during the trial stays saved on your device; you can keep editing it after unlocking.

3. Price and payment

4. Contract and unlocking

The contract is concluded when you complete payment at checkout and Stripe confirms it. The app then unlocks the premium features on your device immediately. Link emails you the receipt.

With your purchase email address and the receipt number, you can restore the unlock on your other devices.

5. No account, your data stays on your device

The app needs no account. Recipes, workouts, measurements and settings are stored only on your device. We have no copy and cannot restore lost data. You are responsible for backups; the app offers a backup feature for this.

6. Right of withdrawal

Consumers living in the EU, the EEA or the United Kingdom have a statutory right of withdrawal. Details are in the withdrawal information.

Before buying, you expressly request that we start unlocking immediately and acknowledge that you thereby lose your right of withdrawal. Your right of withdrawal therefore ends when the unlock takes place.

In Switzerland and other countries, a right of withdrawal exists only where mandatory local law provides for one.

7. Refunds and locking

If a payment is fully refunded or charged back, the license ends. The app locks the premium features at its next online check. Your data on the device is kept.

8. "Lifetime", availability and updates

"Lifetime" means: the unlock applies without a time limit to the current VitalityHub suite and its regular product updates for as long as we offer the app. We may offer future major add-on services separately.

We take due care to keep the app running smoothly but cannot guarantee uninterrupted availability. If we ever discontinue the app, we will let you know in good time. An installed app keeps working offline as far as technically possible.

9. Warranty

To the extent permitted by law, we do not warrant that the app is free of errors or fit for a particular purpose. Mandatory statutory warranty rights, in particular those of consumers, remain unaffected. Please report problems to support@vitalityhub.app.

10. Liability

We are liable without limitation for intent and gross negligence and as required by mandatory law. Otherwise, our liability is excluded to the extent permitted by law.

We are not liable for data loss on your device to the extent that regular backups would have prevented it. Please read the notes on training, nutrition and the medical disclaimer.

11. Changes

We may change these terms for future purchases. Your purchase is governed by the version you accepted when buying.

12. Governing law and jurisdiction

These terms are governed by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Place of jurisdiction is the provider's registered office unless a mandatory place of jurisdiction applies.

Consumers keep the protection of the mandatory provisions and the courts of their country of residence.
